These Terms govern access to our websites, learning platform(s), courses, live sessions, and related services (the “Services”). By enrolling or using the Services, you agree to these Terms. If you use the Services on behalf of an organisation, you confirm you’re authorised to bind it.

3) Eligibility and accounts

Services are for adults (18+) only.

You’re responsible for safeguarding your login and all activity under your account.

Access may rely on third parties such as Wix (platform) and Zoom/YouTube (live/video). Their terms also apply.
4) Course descriptions, enrolment and contract formation

We take reasonable care to describe courses, schedules and pricing accurately; minor updates and improvements may occur.

Consumers: a contract is formed when we confirm enrolment or provide access.

Sponsored/business enrolments: where your employer/sponsor purchases on your behalf, our contract may be with them. With your consent, we may share attendance/progress/completion as agreed with the sponsor.
4.1 Prerequisites, entry assessments and prior learning evidence

Prerequisites: Some modules require completion of specific prior modules or equivalent knowledge. The relevant course page will state any prerequisites.

Entry assessment: We may require an entry assessment (e.g., short quiz, portfolio review, or brief interview) to confirm readiness.

Evidence of qualification: We may request proof of A-level (or equivalent) in Mathematics, English and French and/or a relevant degree, or equivalent professional experience. Certified copies or verified digital credentials may be required.

Language of evidence: If documents aren’t in English or French, we may request a certified translation.

If requirements aren’t met: We may offer a preparatory pathway, an alternative module, deferral to a later cohort, or (where applicable) a refund under Section 7.
5) Prices, taxes and changes

Prices are shown at checkout and are exclusive of any applicable taxes unless stated otherwise.

We may change prices from time to time; changes don’t affect confirmed orders already accepted.

Obvious pricing errors may be corrected.
6) Payments and access

Accepted methods: PayPal and bank transfer.

Access to paid content may start only after cleared funds. For bank transfers, use the provided reference and pay within the stated timeframe.

If a payment is reversed or overdue (B2B), we may suspend access and charge lawful late-payment interest.
7) Cancellations, refunds and consumer rights (UK/EU)
7.1 Cooling-off period

You may have 14 days from the day after order acceptance to cancel.

Digital content: if you ask us to start access during the cooling-off period, you acknowledge we begin performance immediately and you lose the right to cancel for that content once access starts.

Live online sessions: cancel 7+ days before the first session for a 100% refund (less any non-recoverable third-party charges). Cancel <7 days before the first session or after it starts: no refund. You may request a seat transfer to a later cohort (subject to availability).
7.2 How to cancel
Email cve90462@myport.ac.uk with your order details. Refunds are made to the original payment method within 14 days of confirmation.
7.3 Sponsored/B2B
Unless otherwise agreed, B2B purchases are non-cancellable and non-refundable once access is provisioned.
8) Course delivery, changes and rescheduling

We may update content to reflect best practice or standards.

We may reschedule sessions or substitute instructors where necessary (e.g., illness, low enrolment, force majeure). If we cancel without a reasonable alternative, you’re entitled to a full refund of course fees paid.

We aren’t responsible for indirect costs (e.g., travel).
9) Certification and CPD

Where stated, learners who meet completion criteria will receive a certificate of completion/attendance.

CPD recognition (if applicable) is indicated in the course description. CPD provider reference: #788272. Recognition by third parties isn’t guaranteed.
10) Intellectual property and licence

All course materials (videos, recordings, assessments, docs, graphics, code, etc.) are owned by BIMXcellence or our licensors.

We grant learners a personal, non-exclusive, non-transferable, revocable licence to use materials solely for individual learning.

Do not copy, share, resell, publicly perform, record live sessions, or create derivatives without written permission. Limited personal downloading/printing is allowed where expressly enabled.
11) Acceptable use and community standards
Don’t upload unlawful/infringing content; don’t harass or impersonate; don’t bypass security; don’t scrape or bulk-download; don’t share exam content outside permitted contexts. We may remove content or suspend access for breaches.
12) Platform availability

Platform provided via Wix; live/video via Zoom and YouTube.

We use reasonable care and skill, but continuous, error-free availability isn’t guaranteed. Planned maintenance or third-party outages may affect access; we’ll try to give notice of significant disruptions.
13) Data protection
We act as controller of personal data. See our Privacy Policy for details, including sponsor sharing (with learner consent). Privacy queries/rights: cve90462@myport.ac.uk.
14) Disclaimers
Training is for education and general information only, not professional advice. You’re responsible for applying knowledge appropriately and complying with laws/standards/contracts. Except for non-excludable consumer rights, Services are provided “as is” and “as available.”
15) Liability
Nothing limits/excludes liability for death or personal injury due to negligence, fraud, or other non-excludable liabilities.
Consumers: We’re liable for foreseeable loss caused by our breach/failure to use reasonable care and skill; not liable for non-foreseeable loss or business losses.
Business customers: To the fullest extent permitted, we exclude implied terms; total liability is capped at fees paid in the preceding 12 months; no liability for indirect/consequential loss, loss of profits, revenue, data, goodwill or business interruption. Indemnity applies for your breach/misuse (B2B only).
16) Suspension/termination
We may suspend/terminate for material breach, non-payment, or legal requirement. You may stop using the Services at any time. Termination doesn’t affect accrued rights.
17) Third-party services and links
We link to and integrate third-party tools. We’re not responsible for their content/terms/policies.
18) Changes to these Terms
We may update these Terms to reflect changes in Services, business or law. For material changes, we’ll post the update and, where appropriate, notify you. Continued use after the Last updated date means you accept the changes.
19) Force majeure
No liability for delays/failures caused by events beyond reasonable control (e.g., acts of God, pandemics, government action, labour disputes, utility/internet failures, third-party outages).
20) Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. Consumers may also rely on mandatory protections of their local law. Courts of England and Wales have exclusive jurisdiction, except consumers may bring proceedings locally.
